Sweet as a Peach Creative: Terms of Service

1. Nature of Services (Digital Only) All deliverables provided by Sweet as a Peach Creative Agency are 100% Digital. No physical items (flyers, business cards, merchandise) will be shipped unless specifically stated in a custom print package. Final files will be delivered via email, Google Drive, or WeTransfer upon full payment.

2. The Design Process & Timeline

• Turnaround Time: Standard projects require 10–14 business days to complete from the date of the initial consultation. Rush orders may incur an additional fee.

• Onboarding: Upon purchasing a package or paying a deposit, you will receive an automated email with a Creative Brief link.

• Consultation: Once the brief is submitted, we will schedule a 30-minute consultation via Zoom to discuss your vision.

  • Local Clients: If you are located within the Bessemer/Birmingham area, in-person meetings can be arranged at a local coffee shop or office.

3. Payment Structure

• Deposits: A non-refundable deposit (typically 50% or a set booking fee) is required to secure your spot on our design calendar. Work will not begin until this deposit is paid.

• Final Balance: If you chose a deposit plan, the remaining balance is due immediately upon approval of the final proofs.

• No Watermarks: Final, high-resolution source files (without watermarks) will only be released after the final balance is paid in full.

4. Revisions To ensure efficient turnaround times, all packages include three (3) rounds of revisions.

• Please provide all feedback in a consolidated email/list.

• Additional revisions beyond the included three rounds will be billed at an hourly rate of $75/hr.

5. Cancellation & Refund Policy

• Before Work Begins: If you cancel before the design process has started (before the consultation), you are eligible for a full refund minus a 5% processing fee.

• After Work Begins: Once design work has started, deposits are non-refundable. This covers the designer's time, research, and concepting labor.

• Agency Cancellation: If we (Sweet as a Peach) cannot complete your project for any reason, you will receive a 100% refund.

6. Project Abandonment (The "Ghosting" Clause) Effective communication is required to complete your project.

• The 10-Day Rule: Once the final proof is sent, you have 10 days to provide feedback or make the final payment.

• If we do not hear from you within 10 days, the project will be considered Abandoned.

• Abandoned projects are subject to a $150 Reactivation Fee to be placed back on our schedule. If the project remains abandoned for 30 days, it will be archived, and no refunds will be given.

7. Ownership & Copyright

• Client Ownership: Upon full payment, the client owns the rights to the final approved visual designs for use in their business.

• Agency Rights: Sweet as a Peach Creative retains the right to use the designs in our portfolio, social media, and marketing materials for promotional purposes.
